Terms & Conditions for LevitaLift Training Courses
Background
LevitaLift is committed to providing high-quality training services.
Our tutors possess the necessary qualifications, experience, and abilities to deliver exceptional training to students.
By enrolling in our courses, students agree to the terms and conditions outlined in this agreement and commit to putting forth their best effort in all tutoring sessions and practice work.
Training and Assessment Methods
Our instructional program seamlessly integrates theoretical knowledge with hands-on practical experience.
Each session offers immersive massage practice, allowing students to apply acquired knowledge in real-world settings.
Assessment evaluations are conducted upon completion of each course module and may include theory examinations, practical assessments, or assigned coursework.
Fees
Outstanding Fees: Participants with outstanding fees will not be permitted to graduate until all fees are paid in full.
Deposit: A non-refundable deposit fee is required to secure your enrollment. This fee covers administrative costs and confirms your commitment to the course.
Remaining Balance: The remaining balance must be paid before or on the first day of the course.
Payment methods include bank transfers (completed no later than ten working days before the first training day) and cash (settled before the class begins on the first day).
Surcharges: PayPal payments incur a 5% surcharge, and credit card payments incur a 2.5% surcharge.
Refund Policy
The Tutor will not be responsible for travel, accommodation, or other financial implications incurred by the student.
Cancellation: Students must notify the Tutor or their deputy in writing of their intention to withdraw from a course.
Refunds:
Cancellations three (3) or more weeks before the course start date will receive a refund of the Application Deposit.
Cancellations less than three (3) weeks before course commencement are non-refundable.
Cancellations after course commencement are non-refundable.
Medical/Emergency Cancellations: In such cases, fees may be held in credit for use within 12 months, subject to a $100 administration fee.
Course Cancellation by Tutor: A full refund of fees paid will be issued if the course is canceled by the Tutor.
Confidentiality
Confidential information refers to any data or information relating to the student that is considered private or proprietary.
The Tutor agrees not to disclose any confidential information without authorisation from the student or as required by law.
This confidentiality obligation continues indefinitely, even after the termination of this agreement.
Ownership of Intellectual Property
All intellectual property developed during the course remains the property of the Tutor.
Students are granted a non-exclusive limited-use license for this intellectual property.
Photography/Video Release
Students may be photographed or videotaped during activities.
The Tutor may use these materials for editorial, promotional, or advertising purposes.
Students may opt out by notifying the Tutor in writing before the course begins.
Independent Tutor
The Tutor operates as an independent contractor and not as an employee.
This agreement does not create a partnership or joint venture between the Tutor and the student.
Right of Substitution
The Tutor may hire a third-party sub-tutor to perform obligations under this agreement.
The student will not engage third parties to assist with services.
Payment remains the responsibility of the student to the Tutor.
Equipment
The Tutor will provide all necessary materials and supplies to deliver services.
Indemnification
Each party agrees to indemnify and hold harmless the other party against any claims, losses, or damages arising from acts or omissions related to this agreement.
This indemnification survives the termination of the agreement.
Modification of Agreement
Amendments or modifications to this agreement will only be binding if made in writing and signed by both parties.
Entire Agreement
This agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings.
Enurement
This agreement benefits and binds the parties and their respective heirs, executors, administrators, and permitted successors and assigns.
Titles/Headings
Titles and headings are for convenience only and do not affect the interpretation of this agreement.
Governing Law
This agreement is governed by the laws of the country where services are provided.
Specifically, this agreement will be governed by the laws of the United Kingdom.
Dispute Resolution
Parties agree to resolve disputes through friendly consultation, mediation, and, if necessary, binding arbitration under relevant governing body rules.
Force Majeure
Neither party is liable for delays or failures in performance due to circumstances beyond their control, including natural disasters or acts of God.
Health and Safety
Students agree to adhere to health and safety guidelines provided by the Tutor. The Tutor ensures compliance with relevant regulations.
Acknowledgement
The parties have duly affixed their signatures under hand and seal on the specified date.
